Incoterms® Explained

Don’t underestimate the impact of these vital rules – they have the power to influence all aspects of international trade.

In the dynamic world of international trade, precision and clarity are key to successful transactions. This is where Incoterms steps in as a beacon of understanding.

Short for "International Commercial Terms," Incoterms are a universally recognised set of rules that define the responsibilities of buyers and sellers in global trade.

Updated every decade, these are published by the International Chamber of Commerce (ICC), which has been the issuing body since 1930.

What are Incoterms?

At their core, Incoterms are a standardised framework that lays out the rights and obligations of both buyers and sellers in international trade.

These rules clarify vital aspects such as the point of delivery, risk transfer, and payment responsibilities.

By establishing a shared language, Incoterms help prevent misunderstandings, reduce disputes, and enhance the efficiency of cross-border transactions.

Providing Incoterms to Your Customs Agent

The declarant plays a vital role in supplying the chosen Incoterms to their customs agent. It's important to note that customs agents cannot dictate which Incoterms to use; instead, they depend on the declarant's selection to ensure smooth customs clearance.

By aligning the customs declaration with the chosen Incoterms, the customs agent has the necessary insight to complete the declaration accurately and efficiently. Each Incoterm guides the agent in determining the appropriate value to be declared, the applicable customs duties and taxes, and the required documentation for the shipment.

A Closer Look at Incoterms

Here’s a brief overview of some common terms and their meanings:

  1. EXW (Ex Works): The seller makes the goods available at their premises, and the buyer is responsible for all transportation, customs clearance, and associated costs.

  2. FCA (Free Carrier): The seller delivers the goods to a named place, usually the seller's premises or a carrier's depot. The buyer bears the costs and risks from that point onward.

  3. CPT (Carriage Paid To): The seller delivers the goods to a carrier, or another person nominated by the seller at a specified place. The risk transfers to the buyer once the goods are handed over to the carrier.

  4. CIP (Carriage and Insurance Paid To): Similar to CPT, but the seller also provides insurance coverage for the goods during transit.

  5. DAP (Delivered at Place): The seller delivers the goods to a named place, often a buyer's premises or another agreed-upon location. The seller covers transportation costs, but the buyer is responsible for customs clearance and any additional costs.

  6. DPU (Delivered at Place Unloaded): The seller delivers the goods to a named place, and the buyer takes care of unloading at their destination.

  7. DDP (Delivered Duty Paid): The seller is responsible for delivering the goods to the buyer, including all costs and risks associated with transportation and customs clearance.

Understanding these terms is essential for making informed decisions and establishing successful trade relationships.
